Terms of sale and service
Effective September 4, 2026. These terms govern getresqband.com and every ResQBand product and service. Short version: ResQBand is a carrying accessory and information service, not a medical device, and in any emergency you call 911.
1. Who we are
getresqband.com is operated by Western Allergy Services Ltd., a family-owned Canadian company supplying allergy diagnostics and immunotherapy since 1972, with teams in Victoria BC, Hamilton ON, St. John's NL. Contact us at info@westernallergy.com or 1 866 335 5294. "ResQBand", "we" and "us" mean Western Allergy Services Ltd..
2. What ResQBand is, and is not
ResQBand products are carrying accessories and an emergency-information service for people who carry epinephrine. They are not medical devices. They do not contain, administer, dose or replace any medication, do not diagnose or treat any condition, and are not a substitute for medical care, supervision or an emergency response. The instructions shown on a tapped card are general guidance based on the manufacturer's published use instructions; always follow the label on your own medication and the direction of healthcare professionals and 911 dispatchers. Guaranteed network coverage, phone behaviour, NFC performance and bystander action are outside our control, so the service must never be your only emergency plan.
3. Ordering accessories
Prices are in Canadian dollars and can change without notice; the price shown at checkout is the price you pay, plus applicable GST/HST and, in British Columbia, PST. Payment is processed by Moneris; we never see or store your card number. Shipping is by Canada Post, typically 2 to 5 business days, at the flat rate shown at checkout, free over the threshold shown there. Risk in the goods passes to you on delivery to the carrier; title passes on payment in full. We may refuse or cancel an order for suspected fraud, pricing errors or stock problems, with a full refund of anything paid.
4. Epinephrine through our pharmacy partner
neffy and EpiPen are medications. They are not sold through the cart. Requests submitted on this site are forwarded to our licensed Canadian pharmacy partner, Clearpoint Pharmacy, which independently reviews every request, confirms the requirements that apply in your province, and dispenses and ships the medication. You pay only after the pharmacist confirms, by a secure payment link. The pharmacy's own terms and professional obligations govern the dispensing. Medication prices shown on this site are estimates until the pharmacist confirms them, and medications cannot be returned once dispensed.
5. Returns
Unused accessories in original condition can be returned within 30 days of delivery for a refund of the product price; contact info@westernallergy.com for the return address. Outbound shipping is not refunded and return shipping is yours unless we shipped the wrong or a defective item, in which case we cover it and replace or refund in full. Registered cards can be returned but are deactivated on refund. Medications cannot be returned; see section 4.
6. Card registration and the Tap service
Registering a card requires accurate information. You are responsible for keeping your profile current, for having permission to list your emergency contacts, and for telling them to expect a one-time opt-in text from Western Allergy. Alerts are sent only to contacts who reply YES, as described in our text message program.
The Tap service is a subscription of $0.99 per month, billed monthly by Moneris to the card you provide. It keeps your profile, contact alerts and documented tap history live. You can cancel at any time by emailing info@westernallergy.com from the address on the registration; cancellation takes effect at the end of the paid month and no partial-month refunds are given. If a renewal charge fails we retry and email you; the subscription features pause until payment succeeds. We will give at least 30 days notice by email before any price change. The safety floor never turns off: the manufacturer's use instructions and the Call 911 button work on every card regardless of subscription status.
7. Acceptable use
Do not register a card for a person without their knowledge (a parent or guardian may register for their child or dependant), enter false emergency information, use the alert button other than to help the card owner, probe or disrupt the service, or resell the service. Misuse of emergency alerts can endanger the card owner and may lead to suspension of the profile.
8. Intellectual property
ResQBand and Western Allergy are trademarks of Western Allergy Services Ltd.. neffy is a registered trademark of ARS Pharmaceuticals, marketed in Canada by ALK. EpiPen is a registered trademark of the Viatris group. Site content is ours or licensed to us; you may not copy it for commercial use without permission.
9. Liability
Nothing in these terms excludes liability that cannot be excluded under Canadian law, including under consumer protection legislation. Subject to that, the service is provided as-is, we exclude implied warranties to the extent permitted, and our total liability for any claim connected to a product or the service is limited to the greater of the amount you paid us in the 12 months before the claim and $100 CAD. We are not liable for indirect or consequential losses, or for the acts or omissions of bystanders, carriers, telecom networks or the pharmacy partner.
10. General
These terms are governed by the laws of British Columbia and applicable Canadian law, and disputes belong to the courts of British Columbia, without limiting any mandatory consumer rights of your province. If part of these terms is unenforceable the rest stands. We may update these terms; the effective date above changes when we do, and material changes to the Tap service are notified by email.
